The Defendant alternatively argues that any claim under the ICCTA must be contested within 180 days of receipt of the bill. On June 26, 2003, Defendant ABF filed this Motion to Dismiss all counts of the Complaint, arguing that the Plaintiff's claims are preempted by the Interstate Commerce Commission Termination Act ("ICCTA"), 42 U.S.C. Mastercraft commenced this suit on May 30, 2003, alleging breach of contract, misrepresentation, negligent misrepresentation, and unjust enrichment under state law. Mastercraft alleges that it immediately protested the charges to ABF, by demanding that ABF return the overcharges and by refusing to pay the pending invoices. Nevertheless, in reliance on the alleged oral agreement, Mastercraft paid the invoices.Īt some point later, Mastercraft realized that its shipping costs had increased after commencing business directly with ABF, and believed that ABF was not charging the rates allegedly orally agreed upon. Mastercraft alleges that the invoices sent to Mastercraft for the shipping services did not indicate whether the particular items for which the charges were levied constituted a truck load, or more, or less, than a truck load. In reliance on such promises, Mastercraft ceased shipping through the furniture manufacturer, and began shipping directly with ABF. Mastercraft alleges that as a result of these conversations, ABF promised that Mastercraft could save money by shipping directly with ABF, and that ABF would charge less than $3,000.00 per truck load. In response, Mastercraft spoke directly with ABF to procure shipping services at a lower cost. In December 2000, the furniture manufacturer raised its shipping prices. Mastercraft paid the furniture manufacturer for the shipping directly, but ABF, a motor carrier, actually performed the shipping service. Mastercraft regularly purchased furniture from a furniture manufacturer in El Monte, California. The facts are recited in the light most favorable to the Plaintiff, as they must be for purposes of this Motion to Dismiss. With respect to Count I, alleging Breach of Contract, the motion is DENIED, and the Plaintiff's case shall proceed. Accordingly, Counts II, III, and IV of Plaintiff's Complaint shall be dismissed, as *285 these causes of action under state law are preempted by federal law. As much as I was rooting for the couple to stay together, their story was a touching reminder that life doesn’t always go the way you want it to. But I wouldn’t call it a sad one, either. As Michael and Kenzie’s relationship grows more complicated, the world becomes barren and hostile. That tension spills out into the world as well, especially in the last chapters of the story. So when I came across a scene that had them fighting and yelling at each other, I couldn’t help but feel a little awkward, like I shouldn’t be there. And with just their voices to go by, the way you experience their memories feels intimate, as if you’re eavesdropping on them. Even though you only get fragments of their story, they come across as a likable couple. In a lovely moment early on, you end up in a beautiful rooftop garden where Michael and Kenzie had one of their dates (a reference to San Francisco’s public rooftop spaces). Everything in Maquette’s world is bright and cheery at this point, reflecting the thrill of the characters’ new relationship and how they can’t seem to stop spending time with each other. At first, they’re just exploring the city while getting to know one another. The solutions start off easy enough, like using a golden key to unlock a door, and then later using a giant version of the same key as a bridge to head into the next area. You have to repeat this process over and over to solve many of Maquette’s puzzles. I have no idea how Graceful Decay pulled this off, but it felt like magic whenever I shrunk or enlarged something this way. If you take a regular-sized object and place it in the miniature, a giant version of that object comes crashing down in your world. ![]() If you put an object like a box or staircase in one corner of your world and go to the corresponding spot in the replica, you’ll see that the object is also there (albeit at a much smaller size) and you can pick it up. And what happens in one platform is reflected in the other. In theory, these nested worlds stretch to infinity, but Maquette thankfully limits how far you can go in either direction. If you venture outside your normal-sized platform, you’ll just find a bigger version of the same buildings and trees. Here’s the twist: They’re actually the same world. The interface, although a little dated looking, is simple – at the top you have your compensation section that will work to help flatten the frequency response for either 5” mixing monitors, 8” mixing monitors, or headphones. The concept is really straightforward, but is it effective? It is available in AU, VST, and AAX, for both Mac and PC, and uses iLok for registration. MixChecker is a plugin that goes at the end of your mix buss and emulates different common listening devices for consumers, thus eliminating the need to go on a listening world tour to experience how your track sounds in each situation. What if there were a plugin that models these devices and you could monitor all straight from the comfort of your control room without moving from that ergonomic mesh back chair you dropped $300 on? Audified has come up with a solution with “MixChecker”. It’s an extremely nerve wracking process that needs to happen to ensure audio sounds good across all mediums. We constantly worry about how our mixes will translate and spend precious time exporting, emailing files to ourselves, running to the car, listening on the phone, and repeating until you’ve used up storage space on your email and other devices. We went through each setting, flicking between our track and the reference and making EQ and vocal volume tweaks along the way.We all have multiple speakers in the studio to reference data. With that in mind, we set up an instance of Sample Magic’s Magic A/B ahead of the plug-in, so we could compare our mix with some references while playing them through each speaker setup. ![]() If you have a memory card that had 1GB of photos that you reformatted it and filled it up again with 20GB of data, there is a good chance your old 1GB of data has been overwritten and may not be recoverable.
